About the Case

The FIR was filed on September 10, 2025, against Samir Modi under BNS Section 64 (rape) and Section 351 (criminal intimidation). The complainant, a former employee of Godfrey Phillips, alleged that she was sexually assaulted multiple times since 2019 after being lured with promises of entry into the fashion and lifestyle industry. Reports suggest that the victim was in a relationship with Modi during this period, but later claimed she had been cheated. She further alleged that Modi offered her money to remain silent and not approach the police. Following the issuance of a Look Out Circular (LOC) by the New Friends Colony Police Station, the Delhi High Court at Saket remanded Modi to custody, after which he was formally arrested on charges of rape.

Evidence Presented by Both Prosecution and Defense: Court Extends Remand by Two Days

The Delhi High Court decided on an extended remand of two days on September 19,2025 for the accused, considering the arguments and especially the positive potency report that was presented. A potency report, in legal terms, determines a person’s physical ability for sexual intercourse. While the prosecution, on the basis of these test reports, demanded a 3-day remand, the defense presented WhatsApp chats of the woman allegedly demanding ₹50 crores, accusing her of extortion, which required and was subject to investigation as per the prosecution’s demands. Reports claim Modi had earlier filed complaints on August 8 and 13, 2025, before various police officials, alleging blackmail and extortion by the same woman. The previous criminal records were taken into account during the hearing while he was arrested.

Samir has also fought protracted legal battles tied to his corporate disputes. Just months ago, in May 2025, a Delhi court acquitted him in a defamation case filed by three independent directors of Godfrey Phillips: Lalit Bhasin, Nirmala Bagri, and Atul Kumar Gupta who accused him of tarnishing their reputations amid the boardroom tussle as highlighted by The Economic Times. The previous criminal records and his being found not guilty were used by the defense as a point of argument, claiming he is once again being defamed, as in earlier cases, only for documentary purposes. Samir’s claim and the woman’s accusation of him promising her a job offer in the fashion and lifestyle industry remain unresolved.
