On Thursday, the Ministry of Home Affairs notified the Citizenship (Amendment) Rules, 2026— addressing the issue of dual passports for minors, and introducing electronic Overseas Citizen of India (e-OCI) cards and full online applications facilities. The stricter norms on the dual passport holding pattern of minors was a mandatory step to challenge concerns over dual citizenship misuse. Additionally, the digitalization for the OCI identification was introduced for streamlining the whole procedure. 

The status of Overseas Citizen of India

Overseas Citizen of India (OCI) is a special status held by the foreign citizens of Indian origin. They are allowed to live, work, and travel in India with ease under the OCI Scheme. However, an OCI does not acquire full citizenship and is not granted political rights the same as an Indian citizen. 

Detailed analysis on the new Citizenship (Amendment) Rules

The 2026 Citizenship Rules is a comprehensive overhaul of the Citizenship Rules 2009. An initiative taken by the Union Ministry of Home Affairs, this Citizenship Amendment introduces streamlined services for the Overseas Citizens of India, reducing the extensive paper work, along addressal of the dual passport concern of minors. 

The major features of this Citizenship (Amendment) Rules, 2026 includes—

  1. Digitalization of the OCI status- The new Citizenship rules digitalized the OCI status by transitioning it from a paper-based identity system to a full digital identity system. It introduced the electronic OCI (e-OCI), which will function alongside traditional physical cards. 
  2. Restrictions on dual passports- Under Rule 3 of the Citizenship Rules 2009, a new provision of restricting dual passport availability for the minors has been added. This means  a minor holding an Indian passport cannot possess the passport of any other country, addressing legal loopholes surrounding dual citizenship misuse. 
  3. Digitalization of Registration Process- This provision removed the mandate of duplicate physical submissions— duplicate sets of photographs and documents. All applicants can register, renew or renunciate via online portal— ociservices.gov.in
  4. Fast Track Immigration (FTI) Consent: OCI applicants may now consent to share biometric data for automatic registration under the Fast Track Immigration Programme.
  5. Record as a Digital Database- This facilitates the accumulation of records of the OCI digitally, removing the need for manual files.
  6. Online Renunciation and Cancellation facilities- The processes for renunciation (Rule 34) and cancellation (Rule 35) of OCI status have been shifted online. The government can now instantly cancel the e-OCI, when required, even if the physical card has not yet been surrendered.

The conclusion

These new Citizenship (Amendment) Rules have been introduced by the Government for the convenience of the OCIs and for restricting the dual passport misuses. Additionally, certain provisions which were practiced but not explicitly written in the rules, have been systematically codified. The registration, renunciation and cancellation procedures became easier with the digitalization of the system, and a streamlined, paperless identity status provision via e-OCI is made available through the 2026 Citizenship (Amendment) Rules.
